What to do if Washington Physicians Health Program Disqualifies You
The Washington Physicians Health Program [WPHP] is contracted by the Washington Medical Commission [WMC] and the Department of Health [DOH]. In a recent contract, the purpose is stated “to obtain the services of a qualified monitoring program for potentially impaired physicians, physician assistants, osteopathic physicians, osteopathic physician assistants, podiatric physicians, veterinarians and dentists.” Where WPHP “will provide education, assessment, intervention, referral, monitoring, participant support, administration and reporting services under the contract.”
What happens when WPHP refuses to help a licensee? I.e., making a final determination on its own, internally, that any given licensee may never be eligible for its services? Particularly if WPHP is alleging “a hostile and unprofessional manner” as the basis when the individual has a documented disability that directly relates to such alleged behavior?
There is a Grievance Procedure available through WPHP through its ADA Program Coordinator: Policy Manager - MCN Solutions It appears that it will be reviewed by staff other than those who made the initial ineligibility determination, and with further review available to the licensee of the Board Chair. Otherwise, the licensee has to consider pursuing further review with the Department of Justice or a civil law suit.
